Lawsuit filed against LAPD’s David Shin and Jin-seok Oh

A civil lawsuit has been filed by 28-year-old Kim Nguyen against the LAPD and two of its officers over an incident that occurred in the early morning hours of March 17, 2013.

On that date, after a night out in Koreatown, Nguyen and two male companions were waiting in a restaurant parking-lot for a sober friend to pick them up. Two LAPD officers drove by in a marked patrol car, stopped, and approached Nguyen.

After briefly questioning Nguyen and her two friends, the officers left, but circled back, as Nguyen was running across the street toward a late-night cafe.

She was arrested for public intoxication, with her friends not being told where she was to be taken. They were informed that they would need to call the police department to locate her.

As their vehicle traveled east along Olympic Boulevard, a surveillance camera on a nearby building recorded video showing the vehicle approaching the intersection at Grand Avenue at 3:08 a.m.

Seconds later, the surveillance camera pans a few feet and shows Nguyen lying in the street with the top of her dress down around her waist and her face in the advanced stages of swelling.

Nguyen said she does not remember falling out of the patrol car, but said that she could not have attempted to open the door because according to the police she was handcuffed.

Her jaw was shattered and three different surgeries had to be performed on it. She suffered bleeding on her brain. She also lost several teeth.

The arresting officers are David E. Shin and Jin S. Oh of LAPD’s Olympic division.

People who have seen the surveillance footage and are familiar with the modus operandi of local police officers are speculating that Miss Nguyen was a victim of sexual assault, although she has yet to issue a statement on the matter. (Update: In a deposition given in December 2013, she confirmed an assault.)

Miss Nguyen has a Bachelor of Science degree from UCLA and an MBA graduate degree from Loyola Marymount University.
